Overview
The Supreme Court’s decision in Dobbs v. Jackson Women’s Health Organization abandoning federal constitutional protection for abortion will have far-reaching implications for many aspects of health care, especially in the context of reproductive health. In this presentation, I will demonstrate that Dobbs will dramatically limit pregnant patients’ rights to direct the course of their medical care. Because there will be fewer legal protections for patient autonomy after Dobbs, it will fall to the health care profession to establish clear ethical standards and professional guidance affirming the duty to respect the right of medical self-determination during pregnancy.

At the conclusion of this activity, learners will be able to:

  1. Draw connections between the Supreme Court’s abortion jurisprudence and state court decisions about the right to refuse treatment
  2. Understand how the decision in Dobbs v. Jackson Women’s Health Organization may restrict the right to make health care decisions during pregnancy, including the right to refuse Cesarean section and other interventions during labor and delivery
  3. Recognize the essential role of OB/GYNs and other health care providers in advocating for the rights of pregnant patients, regardless of the political orientation of the state in which they practice
